What is a Fire Risk Assessment?

A Fire Risk Assessment (FRA) is the structured review of fire hazards, people at risk, and existing precautions in a non-domestic building or the common parts of a residential block. It is a legal duty on the Responsible Person under Article 9 of the Regulatory Reform (Fire Safety) Order 2005 (RRO). The Fire Safety Act 2021 clarified that the RRO applies to the structure, external walls and flat entrance doors of multi-occupied residential buildings, and the Building Safety Act 2022 introduced further duties for higher-risk buildings over 18 m or seven storeys.

Every workplace, every commercial building, and the common parts of every block of flats needs an FRA. There is no statutory expiry date, but Section 156 of the Building Safety Act 2022 (in force from 1 October 2023) requires the assessment to be recorded in writing in full for all regulated premises, and reviewed regularly and whenever there is a material change. Industry practice is annual review with a full reassessment every one to three years depending on risk.

The deliverable is a written FRA report identifying hazards, evaluating risk, and listing prioritised remedial actions with timescales. For residential blocks, assessors offer Type 1 to Type 4 scopes: Type 1 is non-destructive common parts only, Type 2 adds destructive sampling of common parts, Type 3 includes a sample of flats non-destructively, Type 4 is the most intrusive and includes destructive inspection of flats. The Responsible Person must act on significant findings.

Why this matters: Failure to carry out a suitable and sufficient Fire Risk Assessment is a criminal offence under the Regulatory Reform (Fire Safety) Order 2005, with unlimited fines on indictment and, where failures place people at risk of death or serious injury, custodial sentences of up to two years for the Responsible Person.
